HB 1243 Summary

• Allows volunteer firefighters without compensation to hold elected office in units receiving fire protection services from their department, excluding clothing allowances, automobile allowances, membership fees, and insurance coverage.

• Permits full-time paid police officers and firefighters to hold elected office in the county, city, or town that employs them.

• Prohibits fiscal body members who are full-time paid police officers or firefighters from voting on budget or salary ordinances for their employing department.

• Requires local units to prepare separate budget and salary ordinances for departments that employ fiscal body members who must recuse themselves from voting.

• Effective July 1, 2013, with grandfather clause allowing individuals serving in dual roles on January 1, 2013, to continue through their current term.
