HB 1253 Summary

• Redefines "approximate location" of underground facilities from a strip at least 4 feet wide to a strip not more than 18 inches horizontally from the outside wall of the facility.

• Requires subsurface installation locating and location of utilities in pavement areas to be performed by a "qualified person" who has completed training meeting Common Ground Alliance guidelines.

• Mandates utility operators maintain and provide access to as-built and record drawings for all live or active underground facilities to locating service providers and excavation/demolition site managers.

• Expands civil liability to allow persons responsible for excavation or demolition (not just utility operators) to bring civil actions for damages resulting from violations, with penalties up to $10,000.

• Effective July 1, 2013.
