Prohibits hospitals from entering exclusive agreements with procurement organizations that would prevent other procurement organizations from procuring anatomical gifts.

Prohibits coroners from entering contracts or exclusive agreements with procurement organizations; coroners are not bound by hospital-procurement organization agreements.

Requires the state department of health to adopt rules establishing criteria for determining death (including brain death) before anatomical gifts may be recovered, with recovery only permitted after a physician declares the donor dead.

Requires procurement organizations to file audited financial statements annually by February 1 with the state department of health, including data on decedents, body parts recovered, and facility distributions.

Effective July 1, 2013.
