House Bill 1356 Summary

• Persons convicted of child molesting under IC 35-42-4-3(a) involving intercourse or deviate sexual conduct are permanently assigned to Class III custody status and ineligible to earn "good time" credit.

• Permanently assigned Class III inmates cannot be reassigned to Class I, II, or IV regardless of disciplinary record or rehabilitation progress.

• Courts must determine at sentencing whether a defendant is a credit restricted felon or permanently assigned to Class III and must advise defendants of the consequences.

• Courts must include in the abstract of judgment whether the person is required to be permanently assigned to Class III under the new provisions.

• Effective date is July 1, 2013.
