HB 1369 Summary

• The prosecuting attorney of the judicial district where the court has jurisdiction represents the state in indirect contempt of court cases.

• The prosecuting attorney must review the relevant facts and legal questions to determine if an indirect contempt case has merit.

• If the prosecuting attorney declines to prosecute after review, the court may appoint another qualified attorney to prosecute the case.

• The appointed attorney must be in good standing and admitted to practice law in Indiana.

• Effective July 1, 2013.
