HB 1396 Summary

• Prohibits database owners from making material misrepresentations to Indiana residents regarding collection, use, storage, sharing, or destruction of personal information.

• Prohibits database owners from requiring contractors or vendors to make material misrepresentations to Indiana residents regarding the database owner's handling of personal information.

• Expands the definition of "data" in security breach disclosure laws to include information maintained in computerized format, on paper, on microfilm, or on similar media.

• Removes the term "computerized" from the definition of "breach of the security of data" to clarify that breaches apply to data regardless of the medium on which it is stored.

• Effective July 1, 2013.
