HB 1430 Summary

• Prohibits performing an abortion if the provider knows the pregnant woman is seeking the abortion based on the fetus's sex, the fetus's race, or a parent's race.

• Applies to abortions performed before viability or before 20 weeks of postfertilization age, and separately applies after viability or 20 weeks of postfertilization age.

• Makes violation of the prohibition a Class C felony for any person who knowingly or intentionally performs such an abortion.

• Subjects violators to additional disciplinary sanctions under Indiana Code 25-1-9 in addition to criminal penalties.

• Effective July 1, 2013.
