SB 35 Summary

• Establishes that law enforcement officers who interfere with a person taking photographs or video recordings of officers performing official duties are liable for damages in civil court.

• Applies to digital or analog photographs and video recordings or motion pictures taken of law enforcement officers engaged in official duties.

• Creates exceptions shielding officers from liability if they reasonably believed interference was necessary to enforce criminal law, municipal ordinances, protect public safety, preserve crime scenes or investigations, protect privacy interests, or enforce court rules on judicial proceedings photography.

• Effective July 1, 2013.
