Senate Bill 113 Summary

• Requires the commissioner of the Department of Environmental Management to enter into a contract with local air pollution control agencies whenever they are willing to contract, effective July 1, 2013.

• Mandates contracts must include department requirements to advise, consult, cooperate, and provide technical assistance to local agencies.

• Authorizes local air pollution control agencies to conduct regional air quality monitoring, issue operating permits, perform compliance inspections, respond to complaints and emergencies, and initiate enforcement actions within their jurisdictions.

• Requires fair monetary compensation to local agencies from department funds, with compensation amounts tied to the Consumer Price Index and reviewed annually within 30 days of January CPI-U release.

• Allows compensation funding sources to include EPA federal grants (Clean Air Act Sections 103 and 105), annual operating fees, the environmental management special fund, and other governor-approved revenue sources.
