Senate Bill 157 Summary

• Requires prior approval from the Department of Environmental Management before starting construction of a concentrated animal feeding operation (CAFO) or confined feeding operation, or expanding either operation to increase animal or manure containment capacity.

• Mandates financial assurance requirements for confined feeding operations and CAFOs to cover closure, postclosure monitoring, spill response, and third-party compensation for bodily injury or property damage from accidental or intentional releases.

• Allows financial assurance in the form of performance bonds, certificates of deposit, letters of credit, insurance policies, trust funds, financial self-insurance tests, or corporate guarantees.

• Requires the Environmental Rules Board to adopt rules establishing the specific amounts of financial assurance by January 1, 2014, with graduated amounts based on animal capacity of operations.

• Effective January 1, 2014, with applicants who filed applications before this date required to submit proof of financial assurance no later than July 1, 2014.
