Senate Bill 183 Summary

• Prohibits abortion if the person performing it knows the pregnant woman is seeking it because of the fetus's sex, Down syndrome diagnosis, or genetic abnormality diagnosis.

• Makes intentional performance of a sex-selective abortion or abortion based on Down syndrome or genetic abnormality diagnosis a Class C felony.

• Pregnant women who obtain such abortions cannot be prosecuted for violating or conspiring to violate this law.

• Persons violating this chapter may face criminal penalties, disciplinary sanctions, and civil liability for wrongful death and medical malpractice.

• Effective July 1, 2013; defines "Down syndrome" as chromosomal disorder with extra chromosome 21, and "genetic abnormality" as any genetically inherited disease, defect, or disorder.
