SB 188 Summary

• Adults age 21+ who know a minor possesses alcohol on their property must prohibit possession, confiscate the beverage, and immediately contact the minor's parent or guardian.

• Exceptions apply when alcohol is possessed during religious observations, in the presence of a parent/guardian, or at postsecondary educational institutions.

• Violations are Class C infractions, or Class B infractions if six or more minors possess alcohol on the property or the person has a prior violation of this section.

• A person may be charged with only one violation per day under this section.

• Penalties for violations are in addition to any criminal penalties for contributing to the delinquency of a minor.
