SB 196 Summary

• Excludes misdemeanor possession of marijuana convictions from counting toward habitual substance offender sentencing enhancement if the marijuana amount was 30 grams or less.

• Amends IC 35-50-2-10 to modify the definition of "substance offense" to except small-amount marijuana possession from the habitual offender statute.

• Maintains that habitual substance offender convictions still require proof of two prior unrelated substance offense convictions.

• Effective July 1, 2013.
