Senate Bill 230 Summary

• Declares that any federal act, order, law, rule, regulation, or statute found by the Indiana General Assembly to be inconsistent with the Constitution of the United States is void in Indiana.

• Grants Indiana residents a private right of action to enjoin enforcement or implementation of federal laws declared void, with prevailing plaintiffs entitled to recover reasonable attorney's fees and costs.

• Makes it a Class D felony for any person to knowingly or intentionally implement, enforce, or attempt to enforce a federal law declared void by the General Assembly.

• Specifically finds that the federal Patient Protection and Affordable Care Act (P.L. 111-148) and the federal Health Care and Education Reconciliation Act of 2010 (P.L. 111-152) are inconsistent with constitutional powers granted to the federal government.

• Takes effect upon passage and declares an emergency for this act.
