Senate Bill No. 299 Summary

• Prohibits employers from using credit reports in hiring decisions or determining continued employment, effective July 1, 2013.

• Allows credit report use only if information is substantially job-related for positions with access to money, assets, or confidential information, or for managerial, law enforcement, or attorney general positions.

• Exempts persons or businesses subject to federal Fair Credit Reporting Act sections 6801-6809 that have state or federal regulatory oversight.

• Permits employees and prospective employees to bring civil actions for violations, with courts awarding actual damages, court costs, attorney's fees, and injunctions against further violations.

• Preserves all other employee rights and remedies under state or federal law.
