• Requires contractors awarded public works contracts by the state to employ Indiana residents as at least 80% of their workforce and to subcontract only with subcontractors meeting the same 80% requirement.

• Defines "resident of Indiana" as a person age 18+ who meets at least one of four criteria: registered motor vehicle, voter registration, child in Indiana school, or deriving more than half their income from Indiana sources.

• Applies the 80% Indiana residency requirement to contracts entered into by the public works division of the department of administration, state agencies, the ports commission, and the department of transportation.

• Provides that the 80% requirement becomes a goal rather than a requirement if federal funding would be lost due to the state residency mandate, as determined by the federal agency providing the funds.

• Mandates annual reports by August 15, beginning in 2013, documenting the percentage of contractor and subcontractor employees who are Indiana residents on state public works contracts, and establishes Class B infractions for violations.
