Senate Bill 384 Summary

• Prohibits state educational institutions supported by general assembly appropriations from exercising eminent domain to acquire real or personal property, effective July 1, 2013.

• Removes condemnation as an acquisition method for state educational institutions in IC 21-34-3-4, IC 21-35-2-7, IC 21-35-3-8, and IC 21-41-3-4, limiting acquisitions to purchase, lease, trade, exchange, gift, devise, bequest, or other non-condemnation means.

• Amends IC 21-17-6-7 to prohibit state educational institutions from using eminent domain in redevelopment projects while allowing other qualified entities to continue using condemnation.

• Modifies IC 21-31-2-12 to specify that while land needed by Vincennes University is for public use, title to such land cannot be taken through eminent domain.

• Removes references to condemnation authority in joint use agreements under IC 21-34-4-3 and eliminates condemnation as a funding mechanism for bonds issued under IC 21-34-5-1 and IC 21-34-6-1.
