SB 386 Summary

• Amends Indiana environmental crime statutes to establish Class C misdemeanor penalties for regulated persons who knowingly violate air pollution control rules under IC 13-17 or knowingly fail to file or maintain records required by the federal Clean Air Act.

• Establishes Class C misdemeanor penalties for regulated persons who knowingly or negligently violate water pollution control permit conditions or filing requirements under IC 13-18, changing the standard from "recklessly" to "negligently" for permit violations.

• Elevates violations to Class D felonies if the offense damages the environment rendering it unfit for human or animal life, and to Class C felonies if the offense results in death of another person.

• Sets mandatory fines of at least $5,000 and not more than $25,000 per day for Class C misdemeanor convictions, with enhanced penalties of $5,000 to $100,000 per day for felony convictions involving prior related convictions.

• Effective date: July 1, 2013.
