Senate Bill 391 Summary

• Enhances penalties for theft, criminal mischief, criminal trespass, burglary, and criminal conversion when committed on agricultural operations or involving livestock, raising offenses to higher felony classes.

• Creates new crime of "unlawful recording of agricultural operations" as a Class A misdemeanor for entering another's property where agricultural operations occur and photographing or video recording without written owner consent.

• Adds structures used for agricultural operations to arson and burglary statutes as Class B felony offenses, with enhanced penalties if bodily injury results.

• Requires the Indiana board of animal health to establish a registry of persons convicted of crimes concerning agricultural operations and livestock.

• Effective July 1, 2013.
