Senate Bill 394 Summary

• Amends IC 35-42-4-7 to create a new criminal offense for law enforcement officers who engage in sexual conduct with minors.

• Makes it child seduction, a Class D felony, for a law enforcement officer to engage in sexual intercourse, deviate sexual conduct, or any fondling or touching intended to arouse or satisfy sexual desires with a child who is at least 16 but less than 18 years of age.

• Requires the law enforcement officer to be at least five years older than the child for the offense to apply.

• Effective July 1, 2013.
