Senate Bill 428 Summary

• Amends Indiana Code IC 34-28-5-4 to establish income-based fine caps for Class C moving violation infractions effective July 1, 2013.

• Limits fines including court costs to $50 for persons whose household income is below federal poverty guidelines.

• Limits fines including court costs to $100 for persons whose household income is at least 100% but less than 200% of federal poverty guidelines.

• Requires persons to present credible evidence of their household income to qualify for the reduced fine amounts.

• Applies to all counties in Indiana and takes precedence over existing fine structures in subsections (f) and (h).
