Senate Bill 436 Summary

• Requires persons selling or furnishing materials, labor, services, equipment, or machinery for construction, alteration, or repair work to provide written notice to the real estate owner within 10 days of first providing materials or labor.

• Notice must be furnished directly to the owner and filed in the county recorder's office within 10 days to establish mechanic's lien rights.

• Expands the definition of covered work to include "services" and "equipment" in addition to materials and labor for original construction and alterations/repairs.

• Allows owners to identify themselves through a notarized affidavit if not listed in county transfer books, providing address and legal description of the property.

• Effective July 1, 2013, reducing the previous notice deadline from 60 days to 10 days after materials or labor are first provided.
