SB 443 Summary

• Allows courts to modify sentences of convicted persons more than one year after they begin serving their sentence if the person is eligible for community corrections placement, without requiring prosecuting attorney approval.

• Permits sentence modification without prosecuting attorney consent if the convicted person would be eligible for community corrections placement if being sentenced at the time of the court's ruling.

• Maintains existing requirement that courts obtain prosecuting attorney approval for sentence reductions or suspensions within the first 365 days of incarceration.

• Requires courts to notify crime victims of any order to reduce or suspend a sentence.

• Effective July 1, 2013.
