Senate Bill 498 Summary

• Reclassifies materials, compounds, mixtures, or preparations containing ephedrine or pseudoephedrine as schedule III controlled substances requiring prescription for dispensing, effective July 1, 2013.

• Repeals the existing law (IC 35-48-4-14.7) that previously allowed over-the-counter sales of ephedrine and pseudoephedrine products subject to purchase limits, age restrictions, and electronic tracking requirements.

• Eliminates related definition sections in the Indiana Code for terms such as "constant video monitoring," "convenience package," "ephedrine," "pseudoephedrine," "retailer," "suspicious order," and "unusual theft."

• Removes the requirement for retailers to maintain electronic sales logs and submit transaction data to the National Precursor Log Exchange (NPLEx) system for over-the-counter ephedrine and pseudoephedrine products.

• Modifies IC 10-13-3-40 to eliminate funding provisions for maintaining an electronic log to record ephedrine and pseudoephedrine sales, redirecting appropriations solely to criminal history data repository operations.
