Senate Bill 606 Summary

• School corporation governing bodies may establish and maintain evening schools, vacation schools, debating clubs, community centers, gymnasiums, recreational facilities, public playgrounds, public baths, and similar activities in school buildings and grounds without charge to residents.

• Governing bodies must obtain voter approval through petition (signed by at least 10% of voters from the last general election) before establishing these public use activities, though they may initiate programs on their own without voter approval.

• School buildings and grounds used for these public activities must not interfere with regular school hours or other educational purposes.

• Governing bodies and their employees are protected from liability for injuries occurring during these activities unless the injury results from gross negligence, willful or wanton misconduct, or intentional misconduct.

• Effective date is July 1, 2013.
