Amends IC 36-8-10-21 to modify how Marion County sheriff's jail commissary funds may be disbursed, effective July 1, 2013.

In counties with a consolidated city (like Marion County), money from the jail commissary fund may be disbursed only upon appropriation by the county fiscal body, which determines the appropriation amounts.

In counties without a consolidated city, money from the fund may continue to be disbursed without appropriation by the sheriff's discretion.

County treasurer shall keep the commissary fund in a designated depository, and the sheriff must maintain records of receipts and disbursements with semiannual reports due July 1 and December 31.

Permitted uses of commissary funds include merchandise for resale, commissary operations, law enforcement training, jail equipment, sheriff's department equipment, inmate discipline activities, crime prevention programs, and other purposes mutually agreed upon by the county fiscal body and sheriff.
