House Bill 1018 Summary

• Prohibits state agencies, including state-supported colleges and universities, from regulating the possession or transportation of firearms, ammunition, or firearm accessories on state-owned or state-leased land and buildings effective July 1, 2014.

• Voids all existing rules, policies, and measures enacted by state agencies before, on, or after June 30, 2014, that restrict firearms, ammunition, or firearm accessories on state property.

• Provides exceptions allowing law enforcement agencies to regulate firearms issued to officers, courts and administrative judges to hear cases, and enforcement of restrictions on persons in community corrections, forensic diversion, or pretrial diversion programs.

• Allows individuals and membership organizations dedicated to protecting firearm rights to sue state agencies for declarative and injunctive relief plus actual and consequential damages if adversely affected by violations.

• Entitles prevailing plaintiffs to recover the greater of actual damages or liquidated damages equal to three times attorney's fees, plus court costs and reasonable attorney's fees.
