HEA 1036 Summary

• Defines "group size" as the number of children who routinely work, learn, eat, sleep, and play together in a child care facility.

• Establishes provider ineligibility for voucher payments based on criminal convictions (felonies related to child health/safety, sex offenses, dangerous felonies, and certain misdemeanors) and requires a 10-year waiting period for other felonies.

• Requires providers to maintain written policies on facility safety and vehicle safety (effective July 1, 2015) and make available daily activities including active/quiet play and daily outdoor play unless weather or health reasons prevent it.

• Mandates providers supply nutritious meals, snacks, and drinking water; maintain working smoke detectors and running water; meet sanitation standards; and ensure continuous child supervision with CPR/first aid certified staff present.

• Requires providers to immediately notify parents and the division (within 24 hours) of serious bodily injuries or death of children in their care and to report suspected child abuse or neglect to authorities.
