HEA 1058 Summary

• Adds Chapter 43 to Indiana Code allowing electronic delivery of insurance notices and documents via email or website posting with affirmative party consent and effective July 1, 2014.

• Requires insurers to provide parties with clear disclosures before obtaining consent, including information about paper copy alternatives, fees, withdrawal procedures, hardware/software requirements, and scope of consent.

• Electronic delivery is equivalent to first-class mail, certified mail, or certificate of mailing for all legally required insurance documents and coverage evidence.

• Adds Chapter 44 permitting property and casualty insurers to post standard policies and endorsements (without personally identifiable information) on their websites instead of mailing, with archived retention for five years after expiration.

• Parties may withdraw consent to electronic delivery with 30 days notice, and insurers must notify parties of hardware/software changes that materially affect access to documents.
