HB 1127 Summary

• Establishes a 10-year statute of limitations for actions against surveyors for deficiencies in land surveys, measured from the date of the survey.

• Defines "date of the survey" as the latest of: the date the survey or work product was certified or recorded, the date field work was completed, or the date the professional service was delivered to the client.

• Adds surveyor liability claims to existing statute of limitations for designers and possessors, which include 10 years after substantial completion of improvements and 12 years after design plans and specifications are submitted.

• Applies to actions based on contract, tort, nuisance, or other legal remedies for survey deficiencies or injuries arising from those deficiencies.

• Effective July 1, 2014; amends Indiana Code IC 32-30-1-5.
