IN HB1185

Adds a legal defense to marijuana possession charges if the person possessed marijuana under a valid prescription or order from a practitioner acting within their professional scope.

Modifies Indiana Code 35-48-4-11 to classify marijuana possession as a Class B misdemeanor (reduced from Class A), except when certain conditions apply.

Establishes enhanced penalties of Class A misdemeanor for possession with a prior drug conviction, and Level 6 felony for prior drug conviction combined with possession of at least 30 grams of marijuana or 2 grams of hash oil, hashish, or salvia.

Maintains Class D felony classification for possession of more than 30 grams of marijuana or 2 grams of hash oil, hashish, or salvia, or for those with prior drug-related convictions.

Becomes effective July 1, 2014.
