HB 1341 Summary

• Applies to annexations with ordinances adopted after April 1, 2014 and prohibits municipalities from amending the annexation ordinance or fiscal plan after the ordinance is introduced, except for settlement agreements or clerical corrections.

• Requires municipalities to submit fiscal plans to the Department of Local Government Finance at least 6 months before the public hearing and municipalities must post the fiscal plan on their website at least 60 days before the hearing.

• Requires the Department of Local Government Finance to review fiscal plans and post comments on its website at least 60 days before the public hearing, with costs paid by the annexing municipality.

• Lowers the remonstrance threshold from 65% to 51% of landowners needed to challenge an annexation, and limits remonstrance hearings to determining only the sufficiency of signatures rather than the merits of the annexation.

• Requires fiscal plans to include detailed information about capital improvements, financing methods, and estimated effects on taxpayers including expected tax rates, tax levies, and service levels.
