HB 1394 Summary

• Includes cigarillos within the definition of "cigarette" for cigarette tax and tobacco products laws, defining cigarillos as rolls with less than 125 millimeters length, 3 grams or less tobacco, or 10 millimeters or less diameter.

• Requires quit smoking signs posted at tobacco retail establishments to include a website and toll-free phone number for smoking cessation assistance from the state department of health.

• Prohibits retail establishments selling tobacco from advertising tobacco products in windows, on building exteriors, or anywhere inside the establishment, including behind the counter.

• Exempts tobacco-only retail establishments that do not allow individuals under 18 years of age to enter from the interior advertising restrictions.

• Violations constitute a Class C infraction with escalating civil penalties up to $1,000, and collected penalties must be deposited in the Richard D. Doyle youth tobacco education and enforcement fund.

• Effective July 1, 2014.
