House Bill 1406 Summary

• Repeals the provision authorizing the Secretary of Family and Social Services and Department of Insurance to investigate and apply for a state innovation waiver under the Affordable Care Act.

• Prohibits state agencies, officers, and employees from engaging in activities that aid enforcement of the Patient Protection and Affordable Care Act or participating in involuntary maternal and early childhood in-home visitation programs established under the law.

• Prohibits Indiana and its political subdivisions from establishing or participating in health benefit exchanges; declares health plans purchased or established in violation of this provision void and unenforceable in state courts.

• Authorizes the Attorney General to bring civil actions for injunctive relief against persons implementing the Affordable Care Act if reasonable cause exists that implementation harms individuals and is in the public interest, with required notice to defendants before proceeding.

• Allows individual taxpayers a deduction from adjusted gross income for federal tax penalties or taxes paid under Section 5000A of the Internal Revenue Code for failing to maintain minimum essential health coverage, effective retroactively for taxable years ending after December 31, 2013.
