HB 1042 - School Bus Camera Enforcement Devices

• School corporations and nonpublic schools may install video recording devices on school buses to capture digital images of vehicles violating school bus arm signal device traffic laws.

• Schools must enter into enforcement agreements with contractors and coordinate with law enforcement agencies to review recorded images and send complaint and summons notices to vehicle owners within 10 days of violations.

• Video recording device technology must activate when amber warning lights and the arm signal device engage, and deactivate when red warning lights cease and the arm signal device retracts.

• Civil penalties for violations are $300 for first offense, $750 for one prior offense within 5 years, and $1,000 for multiple prior offenses within 5 years; no driver's license points may be assessed for camera-detected violations.

• Complaint and summons documents may only be sent if the law enforcement agency has a written report from the school bus operator documenting the alleged violation made during the operator's employment shift when the offense occurred.

• Effective July 1, 2014.
