SB 7 Summary

• Amends Indiana Code 35-47-3 to allow law enforcement agencies to retain confiscated firearms for training officers in proper firearm use or for other law enforcement duties.

• Provides law enforcement agencies discretionary options to dispose of or retain confiscated firearms within 120 days of receipt, including public sale, sale to licensed dealers, transfer to other agencies, release to forensic laboratories, retention for training, or destruction.

• Requires proceeds from firearm sales to first cover administrative costs, with surplus deposited into training funds for county agencies or continuing education funds for city/town agencies, to be used exclusively for officer training or law enforcement purposes.

• Allows law enforcement agencies to delay disposal up to 180 days from receipt of the first firearm if accumulating sufficient firearms to defray administrative costs.

• Applies to firearms not required to be registered in the National Firearms Registration and Transfer Record; creates parallel provisions for federally registered firearms requiring registration within 30 days of receipt.
