SB 28 Summary

• Makes it a Class B misdemeanor for a person to recklessly, knowingly, or intentionally rent property or provide/arrange for property use to allow a minor to consume alcohol.

• Elevates the offense to a Class A misdemeanor if the person has a prior unrelated conviction under this section.

• Elevates the offense to a Level 6 felony if the consumption, ingestion, or use of alcohol is the proximate cause of serious bodily injury or death of any person.

• Provides immunity from civil liability for postsecondary educational institutions and their agents unless the institution itself sells, provides, or furnishes alcohol to a minor or rents/provides property for that purpose.

• Effective July 1, 2014.
