Senate Bill No. 42 Summary

• Requires the Department of Workforce Development to waive repayment of unemployment benefit overpayments when the overpayment resulted from an error by the department, if the individual received benefits without fault.

• Expands existing waiver provisions by removing the "economic hardship" requirement for waivers based on department error (previously required in subsection (h)).

• Allows individuals with overpayments of four or more times their weekly benefit amount to repay over up to 36 months, but limits this repayment plan option to once per lifetime.

• Maintains existing requirements that individuals repay overpayments caused by their own misrepresentation or nondisclosure within six years, with 0.5% monthly interest.

• Effective July 1, 2014.
