SB 46 - Self Defense Summary

• Amends Indiana Code IC 35-41-3-2 to restrict self-defense justifications in three specific situations where force use is prohibited.

• Prohibits a person from using force if they are the initial aggressor, unless they withdraw from the encounter and communicate their intent to stop while the other person continues or threatens unlawful action.

• Prohibits force use if a person reaches safety after escaping an attack and then immediately returns to the attack location or seeks out an attacker, except when returning to their own property or residence or to protect a third person from imminent unlawful force.

• Prohibits force use if a person pursues an attacker or trespasser who has withdrawn or retreated and no longer presents an imminent threat.

• Takes effect July 1, 2014.
