Senate Bill No. 71 Summary

• Requires regional sewer district boards established after June 30, 2014, to be elected by property owners rather than appointed, with elections held at public meetings and notice provided by mail or email to all property owners.

• Mandates that all district boards established before July 1, 2014, with appointed trustees must be amended by January 1, 2015, to transition to an elected board in accordance with the new election procedures.

• Establishes staggered initial terms for elected trustees so no more than one-third of trustees may be eligible for election in any given year, with the board authorized to appoint individuals to fill vacancies for the remainder of a term.

• Prohibits districts from foreclosing on sewer liens or enforcing collection of unpaid sewer fees if the sewer lien or delinquent charges are the only lien or delinquent items on the property.

• Effective July 1, 2014.
