SB 107 Summary

• Transfers regulatory authority over residential and commercial onsite sewage systems from the state department of health to the department of environmental management (IDEM), effective January 1, 2015.

• Extends IDEM authority to regulate all sewage disposal systems in mobile home communities, including those using septic tank absorption fields (IDEM previously regulated only non-septic tank systems).

• Establishes new definitions for "residence" (dwelling for up to 2 families), "commercial facility" (non-residential facility with onsite sewage system), and related onsite sewage system terminology.

• Creates new Article IC 13-20.2 establishing permit requirements, construction standards, and operating procedures for residential and commercial onsite sewage systems administered by local health departments and IDEM respectively.

• Repeals IC 16-41-25 and modifies IC 16-41-27 to shift mobile home community sewage regulation from the state department of health to IDEM's water environmental rules board.
