Senate Bill 116 Summary

• Requires the Indiana Department of Transportation to provide written notice of proposed state highway construction or improvement projects that would close a highway for at least 5 consecutive days to affected county executives, municipal executives, fire protection providers, and local emergency management directors.

• Allows governmental bodies receiving notice to submit written objections to the proposed highway closure within 30 days of notification, stating reasons for their objections.

• Requires the Department of Transportation to respond to any objections received at a regularly scheduled meeting of the affected county board of commissioners, county fiscal body, or appropriate municipal fiscal body.

• Permits the Department of Transportation to alter a proposed project to mitigate the effects of the highway closure, but makes all departmental decisions under this section final and not subject to judicial review.

• Becomes effective July 1, 2014.
