SB 139 Summary

• Expands definition of "attendant care services" effective July 1, 2014, to explicitly include assistance with controlled substances, prescription drugs, eye drops, herbs, supplements, and over-the-counter medications, in addition to previously covered noncontrolled medications.

• Establishes criteria for medication assistance requiring that the individual receiving services be unable to accomplish the task due to impairment and either competent and directing the services themselves, or incompetent with a competent individual consenting to health care on their behalf.

• Removes the July 1, 2014 expiration date from IC 16-19-3-26 concerning the anatomical gift promotion fund, allowing the fund to continue indefinitely.

• Requires the Indiana Donation Alliance Foundation and Donate Life Indiana to submit annual audited reports including all expenditures to legislative leadership and committees before February 1 each year.

• Declares an emergency for the act to allow immediate implementation upon passage.
