Senate Bill 164 Summary

• Relocates the definition of "crime of violence" and removes advisory sentences and sentencing caps for crimes committed in a single criminal episode.

• Makes sentences nonsuspendible for murder, Level 1 felonies, Level 2-3 felonies with prior felony convictions, and Level 4-5 felonies with prior convictions completed less than 10 years prior.

• Changes nonsupport of a child penalty from Level 6 to Level 5 felony if person has previous conviction, and allows courts to reduce penalties upon meeting specified conditions.

• Expands "enhancing circumstance" for drug offenses to apply to prior convictions in any jurisdiction, includes conspiracy/attempt, increases school/park proximity from 500 to 1,000 feet, and adds family housing complexes and youth program centers.

• Creates habitual vehicular substance offender sentencing provision (1-8 years additional imprisonment), increases penalties for human trafficking and various crimes including reckless homicide, child exploitation, robbery, burglary, theft, and identity deception.
