SB 177 Summary

• Allows the Indiana Department of Natural Resources to sell excess inventory nursery stock and wildflower seeds to retail or wholesale licensed nurseries in Indiana that have been inspected, certified, and hold a dealer's license.

• Limits the department's ability to accept orders for excess nursery and wildflower stock to January 1 through April 30 each year, with the option to sell excess stock to wholesale businesses at the department's cost of production.

• Requires the department to publish information about nurseries selling seedlings on the Division of Forestry's Internet website, including nursery name, address, county, contact information, sales type, and tree/bush species offered, if the nurseryman elects to have it published.

• Caps the department's annual increase in nursery stock production at 15 percent of the previous year's total production, minus any excess inventory as of February 1.

• Effective July 1, 2014.
