Senate Enrolled Act No. 223 Summary

• Establishes new Chapter 10 under IC 33-39 governing senior prosecuting attorneys, special prosecutors, and special deputy prosecuting attorneys, effective July 1, 2014.

• Creates a senior prosecuting attorney designation for persons with at least 8 years of prosecuting experience who file an affidavit with circuit and superior courts; the prosecuting attorneys council of Indiana maintains a list of eligible appointees.

• Expands inspector general powers to request appointment as special prosecuting attorney when the regular prosecuting attorney is disqualified, fails to act within 180 days, or refers the case back; a court of appeals judge determines appointment.

• Allows prosecuting attorneys to appoint inspector general or attorney general (with consent) as special deputy prosecuting attorneys to assist in criminal proceedings involving public misconduct or environmental law respectively.

• Establishes compensation limits and reporting requirements for special prosecutors, including semi-annual progress reports to the court and final investigation reports when the target is a public servant.
