SB 254 Summary

• Allows the alcohol and tobacco commission to grant three-way alcoholic beverage permits to restaurants located within unincorporated towns that meet specified criteria.

• Unincorporated towns must have been a settlement or group of residences for more than 10 years, serve as a community center for surrounding residents, and have borne the same name for more than 10 years.

• Restaurants in qualifying unincorporated towns are exempt from annual or monthly gross food sales requirements that normally apply to restaurants outside incorporated cities or towns.

• Restaurants must still meet basic requirements including table service operations, adequate law enforcement coverage, and food being predominantly consumed on premises.

• Effective date: July 1, 2014.
