SB 277 Summary

• Defines "agency" as the department, state board, school corporation, school, or any entity created by statute or executive order that collects, maintains, receives, or stores student information.

• Defines "student information" as data identifying kindergarten through grade 12 students by name, assigned identification number, or any manner by which their identity may be ascertained.

• Permits agencies to release, sell, or transfer student information to third parties only under five specific circumstances: student transfers to another school, postsecondary enrollment, national or multistate assessments, contracts for data bases/assessments/special education/instructional support, and students classified as migrant for federal reporting.

• Allows data sharing agreements with entities conducting audits or evaluations of state or federally funded programs on the agency's behalf.

• Allows data sharing agreements with researchers or research agencies to conduct research on the agency's behalf.

• Effective July 1, 2014.
