Senate Bill 386 Summary

• Requires all persons arrested after June 30, 2014, for burglary, residential entry, crimes of violence, or sex offenses to provide a DNA sample via buccal swab only.

• Allows DNA sample expungement if the person is acquitted of all felony charges, all specified charges are dismissed, or no charges are filed within 30 days of arrest.

• Officers obtaining DNA samples must inform arrestees of their right to expungement and provide a form for requesting it; permits use of evidence other than court orders for expungement.

• Increases DNA sample processing fee from $2 to $4 and allocates $500,000 semiannually to the DNA processing fund.

• Permits courts to revoke or increase bail if DNA evidence shows a defendant committed additional crimes not considered when bail was originally set.
