SB 387 Summary

• Amends IC 10-19-4-2 effective July 1, 2014, to require the Division of Homeland Security to develop a strategic plan for homeland security emergencies and assess state and local security needs; removes requirement to disburse federal and state homeland security money.

• Creates new Chapter 11 (IC 10-19-11) effective January 1, 2015, establishing comprehensive radiation and radioactive material control regulations under the Department of Homeland Security.

• Authorizes the governor to enter into agreements with the Nuclear Regulatory Commission to assume state regulation of byproduct material, source material, and special nuclear material.

• Requires persons possessing radiation sources or radioactive materials to register with the state agency and establishes licensing requirements with civil penalties up to $1,000 per violation per day and Class B misdemeanor penalties for violations.

• Repeals outdated radiation-related definitions from IC 16-18-2 and IC 16-41-35, consolidating radiation control authority under the new homeland security chapter.
